TERMS AND CONDITIONS FOR STUDIO SERVICES
Upon completing and submitting a form for any of my studio services, you automatically agree to the following:
-
You guarantee that
A. If you are having a recording done of an arrangement of another artist's work, you have obtained and can provide proof of permission from the copyright holder to record and use your derivative of their work.
B. If you are recording something you wrote, any lyrics are clean and non-degrading, that the music is, indeed, your original work, and that you assume sole responsibility for the legal protection of your work and that of anyone else who records with you.
C. In any contract service agreement you request, you will abide by copyright law and maintain a standard of conduct that reflects total honest and integrity. -
If you are coming to the studio, you commit without reserve to the following attendance policies:
A. Please dress appropriately. Shirt and shoes are required. No swimwear, bikinis or other overly revealing attire (per my discretion).
B. No foul language
C. Respectful behavior at all times.
D. There is at least one person here who is strongly sensitive to allergens and certain scents, including cigarette smoke, perfumes, certain flowers, scented candles, smells from vaping, alcohol, excess body odor or similarly strong scents. Please be sure you are not carrying any of these smells on you. Perhaps ask a friend who doesn't do any of that if needed just to be sure.
E. You will arrive on time according to any and all scheduled appointments we arrange after your form is submitted and communicate in a respectful and timely manner if there are delays or if you need to cancel, especially if you have requested artists from your own contacts or from my roster to perform for or with you! There is a $25 non-negotiable cancellation fee per musician involved if it's within less than 48 hours.
F. If you are recording, you will come prepared to perform, practiced and ready to go. Please keep in mind, I obviously won't expect perfection and most studio recordings do require several tries before a "good" take is achieved. However, coming un- or under prepared will only cost you more money and both of us more time than necessary, so please do you best to be well practiced.
G. Please be prepared to both provide and listen to feedback. This kind of open communication will go a long way in really making your end result shine! If there's something I am missing about a crucial detail in your recording, kindly point it out. If there's something I think will make your work or performance better, don't be disappointed or offended if I mention it. Great music is, of necessity, a collaborative effort, so bouncing ideas off each other will be a crucial part of the process. - Pay on time. All payments are due (to me and my musicians) within 24 hours of sending an invoice; and while I accept payment within those 24 hours, it might even be more efficient for you to arrange to pay any other artists we work with when you come to perform, before we even begin. I had to do that for my very first release in a studio, and it's not an uncommon practice.
- Since all of my work is contract work, you agree to sign and abide by the conditions on the sample contract shown below. I will send you one customized to your project and needs.
-
You promise to:
A. Hold harmless and indemnify (defend) me and Pulsipher Productions in the case of any copyright claim that may arise as a result of anything created in connection with services I provide for which you or any other party involved has failed to obtain sufficient copyright permission.
B. Not engage in any rude, damaging or any kind of retaliatory behavior if I, at my discretion, determine that you have broken any element of this agreement and, therefore, terminate all services and cease to deliver any previously completed work as a result of you entering into this contract. I don't expect this to happen, because I believe most people (especially musicians) are good. But, if it does, I will send you a gentle notice of contract termination and all further services will be suspended for that project. However, if, for some crazy reason, more than one contract is broken, I reserve the right to deny further services in perpetuity (forever).
These terms are subject to change without notice or at any time if special circumstances arise that warrant, in the business owners judgement, adjustments herein.
These terms shall be enforced in accordance with the laws of the State of Tennessee
